1. Applicability
These Terms apply to all users of the Website, including practitioners, vendors and suppliers of services and/or goods ("Partners”), individuals who access and register on the Website ("Customers”), and visitors of the Website.
2. Services
mySeva.life is an online marketplace that connects Customers with Partners for booking sessions and purchasing related services and products. The Website offers options such as offline sessions, live video streaming for activities including fitness, yoga, nutrition, and mySeva.life branded well-being and wellness sessions and digital products like recorded audio and video content. Prices are set by the Company and its Partners and may change, with special offers and discounts subject to additional terms. However, once a purchase is made, these offers are not obligatory. Partners have the flexibility to set their own rates and schedules, while Customers can choose their preferred Partner and pay for sessions through the Website.
3. Acceptance of Terms
Use of and access to the Website is offered upon acceptance of all terms, conditions, and notices contained in these Terms. By using the Website or any Website Services, or merely browsing the Website, you agree to be bound by these Terms available on mySeva.life Website.
4. Partner Representations
The Partner warrants that it is duly registered and authorised to fulfil its obligations under these Terms of agreement, having obtained all necessary approvals, consents, licences, and authorizations required to enter into and perform its obligations. Partners are paid monthly for delivery of confirmed Customer sessions, with mySeva.life remitting up to 95% of the cost and retaining the balance for Website operation. The Company may adjust payouts or compensation at its discretion, with sufficient notice given to all registered Partners.
5. Eligibility to Use
Users under 18 years old may only access the mySeva.life Website or Services with prior consent from a parent or guardian. mySeva.life does not knowingly collect personal information from children under 14 years old. mySeva.life reserves the right to deny or revoke Website access to any user at any time, including those whose accounts have been suspended or terminated.
6. User Account, Password, and Security
To access our Website Services, you must register and create an account with complete and accurate information. Accounts with false or outdated information may be suspended or terminated. You are responsible for maintaining the confidentiality of your account and password, and for all activities that occur under your account. You must notify us of any unauthorised use or security breach. The use of another user's account is prohibited. We reserve the right to refuse access and limit one active account per user.
You may not assign or transfer your account to any other person or entity. You acknowledge that mySeva.life is not responsible for third-party access to your account resulting from theft or misappropriation. All accounts are monitored by the Website administrator for security and content integrity purposes. In the event that mySeva.life believes, in its sole discretion, that an account is being misused or is in breach of contract, copyright infringement, or other legal claims, mySeva.life and its associates reserve the right to refuse or cancel service, terminate accounts, or remove or edit content.
7. Third-Party Accounts
You will be able to connect your mySeva.life account to third party accounts such as Facebook or Google. By connecting your mySeva.life account to your third party account, you acknowledge and agree that you are consenting to the continuous release of information about you to others (in accordance with your privacy settings on those third party Websites). If you do not want information about you to be shared in this manner, do not use this feature.
8. Fees, Charges, and Subscriptions
You agree to pay all fees and charges incurred while using the Website Services, including any additional taxes or third-party charges. Subscription options may be offered on a monthly, half-yearly, or annual basis.
9. Online Payment Services
We accept payment via Visa, MasterCard, American Express credit cards, and bank debit cards. Our credit card payment processor, Stripe, ensures the safety of your personal and payment information using the highest form of data encryption available and we do not retain any of your credit card information in our Website system. You must provide valid payment details and have sufficient funds or credit to complete transactions. You are responsible for any fees charged by your credit card issuer or bank. Payment receipts and transaction summaries are available through your Customer account dashboard.
10. Security
mySeva.life is committed to protecting and respecting your privacy. The information you provide to us is maintained securely using the highest industry-standard level of Secure Sockets Layer (SSL) software available that encrypts all of your personal information you input and we do not retain any of your credit card information in our Website system. We will not distribute, share or sell your name or personal information to any third party except in the cases noted below.
11. Cancellation and Refund Policy
All sessions purchased in advance will remain in your mySeva.life account for 6 months, after which they will expire with no refund. Prepaid sessions may be used with any Partner of your choice. You may cancel your prepaid purchases at any time prior to session commencement date and time and re-use your purchase with another Partner or use the credit for other Services or Products within the Website. Prepaid subscriptions are non-refundable, non-exchangeable, and non-saleable. For questions regarding a cancellation or refund, please contact [email protected].
If an overpayment has been incurred via our online bill payment service, we will issue a refund to the appropriate payee by the original method of payment. If a Service is cancelled by a Partner, we will issue credit to your Customer account wallet, which can be redeemed for other Services or Products on the mySeva.life Website. The Company is not responsible for unauthorised transactions or obligated to refund any money in such instances.
12. Use of Website
The Company grants you a non-exclusive, revocable, limited privilege to access and use the Website and Website Services, subject to compliance with the Terms of Service. You agree to use the Website Services only for permitted purposes and in accordance with applicable laws and regulations. You may not engage in activities that may adversely affect the use of the Website by the Company or other users.
You must access the Website and materials or Website Services through the interface provided by the Company. You may not use any automated means to access, acquire, copy, or monitor any portion of the Website or Content. The Company disclaims all liabilities arising from offensive content on the Website.
mySeva.life Website is controlled, operated and administered from our offices within the Hong Kong SAR. If you access the Website Services from a location outside the Hong Kong SAR, you are responsible for compliance with your local laws. 24. Arbitration
Any disputes arising from these Terms and Conditions will be resolved through binding arbitration in accordance with the Arbitration Ordinance of the Hong Kong SAR, Cap. 609. The arbitration will be conducted by a single arbitrator and administered by the Hong Kong International Arbitration Centre. The entire dispute, including the scope and enforceability of this arbitration provision, shall be determined by the arbitrator. Unless both you and the Company agree otherwise in writing, the arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of representative or class proceeding. This arbitration provision shall survive the termination of these Terms and Conditions and the arbitrator's award will be final and binding.
25. Class Action Waiver
Arbitration will take place on an individual basis only; class actions are not permitted. You may only bring claims against mySeva.life in your individual capacity, not as a plaintiff or class member in any class action.

This Terms and Conditions agreement is governed by the laws of the Hong Kong SAR and you consent to the exclusive jurisdiction and venue of courts in the Hong Kong SAR in all disputes arising out of or relating to the use of the Website. Use of the Website is unauthorised in any jurisdiction that does not give effect to all provisions of these Terms.
